Testing brought to question with Girl Talk All Day

DJ Girl Talk has released his second record. “All Day” was made available totally free download. The DJ mix record utilizes almost 375 music samples. All together, they create a 71 minute piece of music. Girl Talk “All Day” is being launched for free and will likely spark further discussion of the legitimacy of sampling.

DJ and performer Girl Talk, Gregg Gillis off the stage, has launched his second record. The first album was released in 2008, and he has since been touring with more than 40 tour dates in a year. You can get a free download on the Illegal Art site. It’s the "All Day" album. "All Day" by Girl Talk is supposed to be a long listening piece that is 71 minutes long although it’s split into 12 tracks. On the record, there are about 373 different samples or pieces of songs from the artists.

You will find legal problems with sampling the Girl Talk "All Day" record. In general, with permission, testing of music for a new piece is allowed. The "fair use" of music testing has been something the courts have had to work with considering permission is not always requested. If permission is not obtained, then a sample as little as a "distinctive" three note riff is a right violation based on probably the most recent decision with Bridgeport Music Inc. v. Dimension Films.

The way the Creative Commons license applies to Girl Talk 'All Day'

Due to the all-or-nothing copyright option, another option has been taken by individuals. The Creative Commons permit has been used more and more. With their permission, an artist can release their music for remixing and commercial use. This is because there’s a "Claim and release" system of copyrighting. Due to a Creative Commons non-commercial permit, the Girl Talk "All Day" record can be released. Any person is going to be able to use the work. As long as it’s used for commercial reasons then it’s fine. There is a question of whether Girl Talk needs to be paid for the work although it may be good for Girl Talk to be exposed with this.
