Appeals on prop 8

UPDATE: Unconstitutional is what proposition 8 is being called. Those for prop 8 want the judge to void the amendment and keep the decision.

Chief U.S. District Judge Vaughn Walker is slated to release his ruling today on Proposition 8. Prop 8 supporters have already sought a stay on the ruling if it is against them. Opponents of Prop 8 will appeal it the other way if need be. Civil rights to the California state budget are all a part of the case.

The basics of Prop 8

In 2008, the California Marriage Protection Act, otherwise known as Prop 8, was passed by voters. Because of the voter-added ballot proposition, marriage in California is legal only when made between a man and a woman. When Proposition 8 passed, it overturned the California Supreme Court ruling that legalized gay marriage. $ 39.9 million was spent promoting Prop 8 while those against it spent $ 43.3 million.

Challenge Prop 8 with feds

Prop 8’s federal court challenge was placed in San Francisco. Perry v. Schwarzenegger was filed in federal court following the State Supreme Court upheld the voter initiative in Strauss v. Horton. Those for Prop 8 say that equal protection is not violated with California constitution. Those against it feel like equal protection is entirely and totally being violated.

Appeals to Prop 8 decision

Prop 8 reactions have already begun. Supporters of Proposition 8 have filed an injunction, asking for a stay on marriage should the ruling be found against them. This would mean same-sex marriages could happen while the case is being reviewed. Opponents say they intend on filing appeals if they lose this court case. There can be more money spent on Prop 8 in court nationally. States allowing same-sex marriages are having a better economy than others while gay marriages are controversial around the whole country.
